¹ Notaries are also authorized to charge freely negotiated fees in return for services, provided that these services are not subject to the regulated rate for notaries. In this case, a fee agreement must be regularized with their client.

² This decree incorporates, after application of fixed discounts possibly granted by the notary, the principle of negotiated discounts. Indeed, the rate of discounts mentioned in the second sentence of the sixth paragraph of article L. 444-2 can be agreed between the professional and his client for the portion of emoluments exceeding the emoluments threshold of €200,000.
